Online Store Terms and Conditions

§ 1 DEFINITIONS

Business days - days from Monday to Friday, excluding statutory holidays.
Consumer - Consumer within the meaning of the Civil Code provisions.
Buyer - Entrepreneur making purchases in the store as part of a sole proprietorship.
Entrepreneur - Entrepreneur other than the Buyer.
Customer - Consumer or Entrepreneur or Buyer.
Terms and Conditions - these terms and conditions.
Store - La ROUE online store operated by the Seller at https://larouebrand.com/
Seller - Bold Sp. z o.o., REGON: 5216076120, NIP: 7011081750, registered in the register of entrepreneurs
of the National Court Register kept by the District Court in Warsaw, XII Commercial Division
of the National Court Register under the number KRS 0000963614
Product - product offered in the Store
Price - payment due from the Customer for the concluded sales contract.
Sales Contract - a contract for the sale of Products within the meaning of Article 535 of the Civil Code, concluded
between the Seller as the seller and the Customer as the buyer.
Order - a declaration of will by the Customer submitted to the Seller, containing in particular information
on the quantity of the Product and the place of delivery, as well as other data enabling the conclusion of a Sales Contract
between the Customer and the Supplier.

§ 2 GENERAL PROVISIONS

1. Before placing an Order, the Customer familiarizes themselves with the provisions of these
Terms and Conditions.
2. Placing an Order means:
a. acceptance of the provisions of the Terms and Conditions;
b. the Customer's consent to the processing of personal data to the extent necessary to handle and
fulfill the Order and to exercise rights and obligations in connection with the concluded or future Sales Contract,
in accordance with the Personal Data Protection Act and the provisions of the Privacy Policy;
c. the Customer's consent to the execution of the Dropshipping Agreement by the Intermediary.

§ 4 TECHNICAL REQUIREMENTS
1. To properly make purchases in the Store, you need:
• A device with Internet access
• An Internet browser that supports JavaScript and enables and accepts cookies.
2. To place an order in the Store, apart from the requirements specified in paragraph 1, an active
e-mail account is required.

§ 5 SHOPPING IN THE STORE

1. Prices of Products visible in the Store are total prices for the Product, including VAT.
2. The Product selected for purchase should be added to the cart in the Store.
3. Then the Customer selects from those available in the Store: the payment method for the order, and also provides data
necessary to complete the placed order.
4. The order is placed when the Customer confirms its content and accepts the Terms and Conditions.
5. Placing an order is equivalent to concluding a sales contract between the Customer and the Seller.
6. The Seller will provide the Customer with confirmation of the conclusion of the sales contract no later than at the time of
delivery of the product. A VAT invoice is issued at the Customer's request.

§ 6 PAYMENTS

1. For the placed order, payment can be made, depending on the Customer's choice:
• By standard bank transfer to the Seller's bank account number 79 1140 2004 0000 3102

• By payment card through the Stripe platform,
• Through the Przelewy24 payment platform,
• Through the Apple Pay payment platform,
• Through the Google Pay payment platform.
2. If the Customer chooses payment by traditional bank transfer, payment for the order must be made
within 2 Business days from placing the order.
3. The Seller informs that in the case of some payment methods, due to their specificity,
paying for the order using this method is only possible immediately after placing the order.
4. The Customer making purchases in the Store accepts the use of electronic invoices by the Seller.
The customer has the right to withdraw their acceptance.

§ 7 ORDER FULFILLMENT
1. The Seller is obliged to deliver the Product without defects.
2. The order fulfillment time depends on the Product.
3. Orders with the "Pre-order" option are fulfilled within 14 business days from the end of this sale, i.e.,
from April 28, 2024 - after May 20, 2024.

4. Orders for Products currently available in the Store are fulfilled within a maximum of 7 business
days from confirmation of receipt of payment from the payment intermediary or from posting the transfer
in the case of payment by traditional transfer.
5. Orders are sent via, according to the Consumer's or Buyer's choice:
1. Inpost Parcel Locker for 16 PLN.
2. Inpost Courier for 18 PLN.
3. DHL International Courier for 76 PLN.

§ 8 RIGHT TO WITHDRAW FROM THE CONTRACT

1. The Consumer and the Buyer have the right to withdraw from the contract concluded with the Seller through the Store,
subject to § 9 of the Terms and Conditions, within 14 days without giving any reason.
2. For the Consumer or Buyer to exercise the right to withdraw from the contract, they must inform
the Seller, using the data provided in § 2 of the Terms and Conditions, of their decision to withdraw from the contract by
way of an unequivocal statement (e.g., by attaching the form available in the Store to the return shipment
or by sending a completed form via e-mail).
3. The Consumer or Buyer may use the model withdrawal form placed at
the end of the Terms and Conditions, but this is not mandatory.
4. The cost of the return shipment is borne by the Seller if the Consumer or Buyer has chosen the cheapest available
shipping option. Otherwise, the cost is borne by the Consumer or Buyer.
5. The Consumer and Buyer acknowledge that the return of the Product may not be accepted if it was
sent to the Store cash on delivery and/or if the Product shows signs of use, smells different, or has no tag.

§ 9 EXCEPTIONS TO THE RIGHT TO WITHDRAW FROM THE CONTRACT

1. The right to withdraw from a distance contract does not apply to the Consumer or Buyer
with regard to a contract in which the Product was prepared according to the special order of the Consumer or
Buyer, based on individualized parameters sent by them.
2. The right to withdraw from a distance contract does not apply to an entity other than the Consumer or
or Buyer.

§ 10 NEWSLETTER

1. As part of the operated Store, the Seller provides a free Newsletter service.
2. In order to provide the Newsletter service, the Seller will process the email address and name and
surname of the Customer.
3. The Newsletter service is provided via email and consists of sending the Customer
legal and factual information about activities undertaken by the Seller.
4. For signing up to the Newsletter, the Customer receives a one-time discount code of 5%.
5. Ordering the Newsletter service takes place through registration on the Store's website.
6. The Customer may withdraw consent to receive informational and advertising content by sending an e-mail

§ 11 COPYRIGHT

All copyrights to the Store and all elements of the Store, including in particular photos, belong to
the Seller. Copying, using, distributing elements of the Account is prohibited. The Seller
grants Customers a non-exclusive license to use the Store Account in the following fields of exploitation:
a. reproduction by any technique, including magnetic technique on video cassettes, audiovisual discs,
light-sensitive and digital technique, computer recording technique CD, DVD,
b. display, public performance,
c. the right to trade in the country and abroad,
d. lending, renting, lending, or exchanging media on which the works are recorded,
e. broadcasting by wired and wireless vision or sound by a ground station,
f. broadcasting via satellite,
g. retransmission of works,
h. preparation of foreign language versions of works,
i. introduction to computer memory and to a multimedia network (including the Internet), public
making works available in such a way that everyone can have access to them at a place and time of
their choice,
j. simultaneous and integral rebroadcasting by another television organization in an unlimited number of broadcasts and
circulation sizes.

§ 13 COMPLAINTS

1. In the event of a defect in the Product, the Customer or Buyer or Consumer has the option to complain about
the defective Product based on the warranty or guarantee regulated in the Civil Code, provided that the guarantee
has been granted.
2. Using the warranty, the Buyer or Consumer may, on the terms and within the time limits specified in the
Civil Code:
• Submit a declaration on price reduction,
• Submit a declaration of withdrawal from the contract, unless the Seller immediately and without
excessive inconvenience for the Buyer or Consumer replaces the defective Product with one free
from defects or removes the defect,
• Request replacement of the Product with one free from defects,
• Request removal of the defect.

3. The Seller requests that complaints based on the warranty be submitted to the postal or electronic address
indicated in § 2 of the Terms and Conditions.
4. If an additional guarantee has been granted for the Product, information about it, as well as its conditions, is
available in the product description in the Store.
5. Complaints regarding the operation of the Store should be directed to the e-mail address indicated in § 2 of the Terms and Conditions.
7. The Seller will consider the complaint within 14 days.
§ 13 PERSONAL DATA

1. The administrator of personal data provided by the Customer while using the Store is
the Seller.
2. The Customer's personal data is processed on the basis of a contract and for its implementation, in accordance with the rules
set out in the general regulation of the European Parliament and of the Council (EU) on data protection
(GDPR). Detailed information on data processing by the Seller is contained in the privacy
policy available in the Store at www.larouebrand.com
